Promotion Event Terms and Conditions

This promotion – #whereismyALLY campaign ("Promotion") is hosted by ASUSTeK Computer Inc. ("ASUS").

1. General conditions for Participation

   1. Detailed information with respect to how to play and win prizes in connection with this specific Promotion, ASUS Terms of Use Notice, and ASUS Privacy Policy, constitutes part of this Promotion Event Terms and Conditions ("Terms and Conditions"). Participating in this Promotion is deemed acceptance of these Terms and Conditions. ASUS may at any time revise the Terms and Conditions and other rules set forth by ASUS. Eligible Entrant (as defined below) shall be bound by any such revisions.

   2. This Promotion is open to at least 20 years old and considered an adult by the laws of the country where you reside (“Eligible Entrant”), only excluding employees and immediate relatives of employees of the organizer and/or administrator, their respective parent, subsidiaries, or affiliated companies, or any other person professionally connected with this Promotion.

   3. Participation is permitted irrespective of purchase of a product/service. No purchase necessary.

2. Promotion Details

   1. This Promotion starts on Monday, 7^th August 9:00 GMT+8 and closes on Wednesday, 31^st January 2024 at 23:59 GMT+8 (“Promotion Period”) and hosts worldwide but exclude Russia, Belarus, China and territories or countries where applicable laws either (i) prohibit participating or receiving a prize in giveaways; or (ii) require extra process (such as registration and reporting) for holding giveaways or providing prizes exceeds certain value (“Promotion Territory”).

   2. Promotion Period is divided into 2 waves:

      1^st wave: 7^th August 2023 at 09:00 GMT+8 to 30^th September 2023 at 23:59 GMT+8
      2^nd wave: 1^st October 2023 at 00:00 GMT+8 to 31^th January 2024 at 23:59 GMT+8

   3. To enter the Promotion, Eligible Entrant will need to:

      1. Upload the photos that capture the moment of you with an ROG Ally on Instagram, Twitter or Facebook (each a “Social Platform”, collectively, “Social Platforms") with the hashtag #whereismyALLY”( “Eligible Post”).

      2. The Eligible Post must be set as public.

3. Selection of Winners and Prize

   1. There will be thirty-four (34) prize winners in 1^st wave. The prize winners of the Promotion will be randomly selected from the Eligible Post. The more Eligible Post one has, the more chances for one to be selected. The same photo on a Social Platform can only be counted as one (1) entry. One Eligible Entrant shall be eligible to win only one (1) prize in each wave.

   2. The prize(s) will be unlocked subject to G(ii) in 2nd wave. The more Eligible Posts, the more prizes will be added to the prize pool. The prize winners of the Promotion will be randomly selected from the Eligible Post posted during the 2nd wave of the Promotion Period. The same photo on a Social Platform can only be counted as one (1) entry. One Eligible Entrant shall be eligible to win only one (1) prize in this wave.
      *For example, when 3,000 Eligible Posts are posted, the prize pool will have 38 prizes for 38 prize winners.

   3. Prize winners will be subsequently informed within four (4) weeks after the end of each wave ("Drawing Date") by direct message from ROG fan pages on Social Platforms. The list of prize winners will also be announced on the campaign web page and ROG fan pages on Social Platforms.

   4. Prize winners shall inform ASUS of their contact information within seventy-two (72) hours after receiving the direct message from ROG fan pages on Social Platforms. Any failure of a Prize winner to make the contact information available to ASUS will be deemed a waiver of the right for the prize awarded, and ASUS, in its sole discretion, has the right to conduct a redraw to decide a substitute.

   5. Prize winners are required to provide their full name, physical address, and phone number in the reply to prize notification in order to receive the prize (these data will only be used as a means to deliver the prize to the prize winners). Prize winners guarantee that all information provided is accurate and truthful. ASUS reserves the right to reject winning claims with incomplete or incorrect information.

   6. The prize will be delivered to the prize winner’s indicated address within six (6) months after the Drawing Date. The delivery date may be changed without prior notices.

   7. Prizes:

      1. 1^st wave

         1. Two (2) ROG XG Mobile

            The RRP value of ROG XG Mobile is $ $1,999.99 USD.
            * The specifications of the ROG XG Mobile is varied worldwide and will be provided to the winner of this Prize based on the availability and location of the winner.

         2. Three (3) ROG Strix XG16AHPE

            The RRP value of ROG Strix XG16AHPE is $349 USD.

         3. Four (4) ROG Cetra True Wireless.

            The RRP value of ROG Cetra True Wireless is $99.99 USD.

         4. Twenty (20) XBOX PC Gamepass Ultimate 3 months.

            The RRP value of XBOX PC Gamepass Ultimate is $30 USD.
            * You must create a new Microsoft account for redeeming Prize Code if you have redeemed any Xbox Game Pass Ultimate Code before.
            *The Prize Code will be invalid after 31st December 2023. You will be automatically billed for the subscription to XBOX Game Pass Ultimate at the intervals you selected unless you cancel the subscription or turn off recurring billing in your Microsoft account before 31st December 2023.

         5. <Bonus prize> Five (5) ROG Ally.

            The RRP value of ROG Ally is $699.99 USD.

      2. 2^nd wave: When the eligible posts reach the specified quantity requirements in the table below, the prize(s) will be added to the prize pool

         • 200 Eligible Posts; one (1) gaming controller; The RRP value of gaming controller is $200 USD.

         • 400 Eligible Posts; one (1) gaming controller, one (1) wireless headset; The RRP value of gaming controller is $200 USD, The RRP value of a wireless headset is $99.99 USD.

         • 600 Eligible Posts; one (1) gaming controller, one (1) gaming monitor, Bonus prize: two (2) ROG Ally; The RRP value of a gaming controller is $200 USD, The RRP value of a gaming monitor is $900 USD, The RRP value of a ROG Ally is $699.99 USD.

         • 800 Eligible Posts; one (1) gaming monitor, one (1) XG mobile; The RRP value of a gaming monitor is $900 USD, The RRP value of a XG mobile is $1,999.99 USD.

         • 1,000 Eligible Posts; one (1) game event package for two people, Bonus prize: four (4) ROG Ally; event package is worth $9,000 USD. The RRP value of a ROG Ally is $699.99 USD.

           • The package includes flight tickets, hotel stay, and gaming event tickets for two people visiting a 2024 gaming convention ('Package').

           • The prize winner can choose one gaming convention held in 2024 to attend: Germany, the United States, or Japan.

           • This package should be arranged by ASUS's designated travel agency. ASUS will cover only flight tickets, hotel stay, and gaming event tickets up to USD $9,000; any additional expenses should be borne by the Prize winner.

           • If the convention(s) do not take place or other unforeseen circumstances occur, ASUS reserves the right to adjust the package.

           • ASUS is not responsible for the arrangement of the Package, including but not limited to flight delays.

         • 1,500 Eligible Posts; two (2) XG mobile; The RRP value of a XG mobile is $1,999.99 USD.

         • 2,000 Eligible Posts; one (1) game event package for two people, Bonus prize: six (6) ROG Ally; event package is worth $9,000 USD. The RRP value of a ROG Ally is $699.99 USD.

           • The package includes flight tickets, hotel stay, and gaming event tickets for two people visiting a 2024 gaming convention ('Package').

           • The prize winner can choose one gaming convention held in 2024 to attend: Germany, the United States, or Japan.

           • This package should be arranged by ASUS's designated travel agency. ASUS will cover only flight tickets, hotel stay, and gaming event tickets up to USD $9,000; any additional expenses should be borne by the Prize winner.

           • If the convention(s) do not take place or other unforeseen circumstances occur, ASUS reserves the right to adjust the package.

           • ASUS is not responsible for the arrangement of the Package, including but not limited to flight delays.

         • 2,500 Eligible Posts; three (3) XG mobile, three (3) Gaming monitor; The RRP value of a XG mobile is $1,999.99 USD, The RRP value of a gaming monitor is $900 USD.

         • 3,000 Eligible Posts; one (1) game event package for four people, Bonus prize: eight (8) ROG Ally; event package is worth $18,000 USD. The RRP value of a ROG Ally is $699.99 USD.

           • The package includes flight tickets, hotel stay, and gaming event tickets for two people visiting a 2024 gaming convention ('Package').

           • The prize winner can choose one gaming convention held in 2024 to attend: Germany, the United States, or Japan.

           • This package should be arranged by ASUS's designated travel agency. ASUS will cover only flight tickets, hotel stay, and gaming event tickets up to USD $18,000; any additional expenses should be borne by the Prize winner.

           • If the convention(s) do not take place or other unforeseen circumstances occur, ASUS reserves the right to adjust the package.

           • ASUS is not responsible for the arrangement of the Package, including but not limited to flight delays.

   8. Prizes are non-exchangeable, non-transferable, and cannot be converted into cash or substituted for any other item, model, or color.

   9. Prize winners are responsible for all applicable taxes and expenses not specified in the prize description. It is the prize winners' responsibility to comply (at their own expense) with any applicable laws requiring payment of any tax, duty, levy or similar impost relating to the award of the prize, and ASUS shall have no responsibility in respect thereof.

4. To the extent permitted by applicable law, ASUS shall not be liable for any indirect, special, or consequential costs, expenses, losses, or damages suffered by the Prize winner. This includes situations where such costs, expenses, losses, or damages were reasonably foreseeable or might reasonably have been contemplated by the Prize winner and ASUS, whether arising from a breach of contract, tort, negligence, breach of statutory duty, or otherwise.

5. For any reviews/ articles/ posts/ ratings about your user-generated content or using experience of ASUS products/ services on ASUS or on 3rd party platforms, you should disclose material connections between you and ASUS in such reviews/ articles/ posts/ ratings (for example, by stating “sponsored post by ASUS” or “promoted post by ASUS” in Entrant’s reviews/ articles/ posts/ ratings).

6. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram, Twitter, and Facebook. You agree to grant Instagram, Twitter, and Facebook a complete release regarding this Promotion. You acknowledge that you are providing your comments and Personal Information to ASUS and not to Instagram, Twitter, and Facebook; and such information and Personal Information will only be used for this Promotion.

7. License to ASUS et seq. for Released Publicity Content. By entering the Giveaway, Entrants grant Sponsor and its affiliates a royalty-free, worldwide, perpetual, non-exclusive license to display, distribute, reproduce and create derivative works of the entries (“Released Publicity Content”), in whole or in part, in any media now existing or subsequently developed, for any promotional, publicity, and exhibition purposes. Any such use may or may not include any credit or attribution. Sponsor will not be required to pay any additional consideration or seek any additional approval in connection with such uses. Except as prohibited by law, Entrants waive any moral rights they may have in any Released Publicity Content, even if such Released Publicity Content is altered or changed in a manner not agreeable to Entrant.
